These Terms & Conditions govern all purchases of materials and any installation services arranged through Floors To Go. By placing an order, submitting payment, approving an invoice, or permitting installation to proceed, the purchaser acknowledges and agrees to be bound by these Terms & Conditions.
- All product returns are subject to a restocking fee ranging from 20% to 35%, based on individual vendor policies.
- No returns will be accepted after thirty (30) days from the date of purchase.
- All returns are subject to evaluation and approval in accordance with the applicable manufacturer or vendor's return policy.
- All shipping, transportation, handling, and related costs associated with returned items shall be borne solely by the purchaser.
- This agreement constitutes a firm and binding contract and is not subject to cancellation by the purchaser once materials are ordered or labor is scheduled.
- Deposits are non-refundable once materials are ordered or installation has been scheduled.
- All material and shipping costs must be paid in full prior to shipment.
- We accept credit card and ACH payments through our third-party payment portal.
- Labor requires a 50% deposit prior to scheduling installation, with the remaining balance due upon job completion.
- Failure to remit payment when due may result in delays, suspension of work, or additional fees.
- All measurements, material quantities, and estimates are approximate and based on information available at the time of estimation.
- Actual site conditions, layout changes, cutting requirements, or material waste may require additional materials or labor, which will be billed separately.
- Floors To Go is not responsible for shortages or overages resulting from field conditions or unforeseen circumstances.
- Floor installation may require sub-floor preparation, which cannot always be determined until the removal of existing flooring.
- Any additional work or repairs to the sub-floor, whether apparent or latent, are not included in the initial estimate and shall be subject to additional charges, payable by the purchaser.
- Flooring performance is dependent on acceptable moisture levels and proper substrate conditions.
- Moisture testing may be performed at the installer's discretion. Floors To Go is not responsible for flooring failures caused by moisture levels, vapor emissions, or substrate conditions that fall outside manufacturer specifications.
- Floors To Go does not provide plumbing or electrical services.
- On a case-by-case basis and solely at the discretion of the installer, disconnection of appliances such as refrigerators, ovens, and dishwashers may be performed. Under no circumstances will any appliances be reconnected.
- The purchaser is solely responsible for arranging reconnection by licensed plumbers or electricians.
- Floors To Go shall not be held liable for the disconnection or reconnection of any wires, including but not limited to those associated with security systems, phone lines, or communication devices.
- We do not remove or alter plumbing fixtures, including but not limited to toilets, sinks, or shower/bath piping.
- Floors To Go is not responsible for trimming or cutting doors.
- If door modifications are necessary and the installer is capable of performing such work, additional charges will apply.
- Flooring products are manufactured in batches and may exhibit natural variations in color, shade, texture, grain, pattern, or finish.
- Samples, showroom displays, photographs, and marketing materials are representative only and may not exactly match the final installed product.
- Floors To Go does not guarantee exact color or shade matching between samples, displays, and installed materials, including between different dye lots or production runs.
- The purchaser is responsible for ensuring the jobsite is accessible, clean, and ready for installation at the scheduled time.
- Delays caused by lack of access, unfinished work by others, pets, furniture not removed as required, or other site conditions may result in rescheduling and additional charges.
- All flooring installations are performed in accordance with applicable manufacturer installation guidelines.
- Any deviations requested by the purchaser may void manufacturer warranties and are not recommended. Floors To Go is not responsible for warranty issues resulting from deviations from manufacturer specifications.
- Floors To Go is a flooring showroom and retailer of materials. Any installation services arranged through Floors To Go are performed exclusively by independent third-party subcontractors and not by employees, agents, partners, or representatives of Floors To Go.
- All installers are independent contractors who retain sole control over the means, methods, techniques, sequences, and procedures of their work. Floors To Go does not supervise, direct, or control the day-to-day performance of installation services.
- Floors To Go's role with respect to installation services is strictly limited to facilitating scheduling, payment processing, and customer communication as a convenience to the purchaser.
- Independent subcontractors are solely responsible for:
- The quality and workmanship of installation
- Compliance with all applicable laws, building codes, and licensing requirements
- Maintaining their own insurance coverage, including liability and workers' compensation
- In the event of an installation-related concern, the purchaser agrees to notify Floors To Go first. Floors To Go will work in good faith to facilitate communication between the purchaser and the subcontractor; however, Floors To Go does not guarantee outcomes or assume responsibility for corrective work beyond the limited labor warranty expressly stated herein.
- Floors To Go shall not be liable, directly or indirectly, for any acts, omissions, negligence, delays, property damage, personal injury, or workmanship issues caused by any independent subcontractor.
- Any claims arising from installation workmanship, property damage, or performance shall be pursued directly against the subcontractor, except to the extent covered by Floors To Go's expressly stated one-year labor warranty, which represents the sole and exclusive remedy against Floors To Go.
- Nothing in this agreement shall be construed to create any joint venture, partnership, agency relationship, or employment relationship between Floors To Go and any installer.
- These provisions are intended to clearly define the relationship between Floors To Go and its installers and to set reasonable expectations for purchasers regarding installation services.
- The placement and location of seams in flooring materials shall be at the sole discretion of the installer and are not considered defects.
- Cut pile carpet may display shading, footprints, and pile reversal. These are normal characteristics and are not considered defects.
- Wood, laminate, vinyl, and similar materials may experience color changes, fading, or natural variation over time due to sunlight exposure, moisture, or environmental conditions. These changes are not covered by warranty.
- Floors To Go assumes no responsibility for flooring issues arising from excessive moisture, alkali presence, hydrostatic pressure, or chemical reactions from asphalt or blacktop surfaces.
- Installers are not professional movers.
- Installers may move minimal furniture at their discretion and within the agreed scope of work.
- For large quantities of furniture or heavy items, the purchaser is responsible for arranging a professional moving service prior to the start of work.
- Floors To Go and its subcontractors are not liable for damage to furniture or personal items moved as part of installation assistance.
- Additional charges may apply for furniture moving.
- Items that will not be moved include, but are not limited to: billiard tables, glass furniture, aquariums, pianos, and other specialty or heavy items. If assistance is provided with such items, Floors To Go assumes no responsibility for damage, reassembly, or leveling.
- Floors To Go warrants its labor for a period of one (1) year from the date of installation. This labor warranty is limited to the correction of installation-related workmanship issues and does not create an employment, agency, or supervisory relationship with any independent subcontractor.
- Product defects are covered exclusively under the manufacturer's warranty.
- Labor related to product defects is not covered unless the manufacturer agrees in writing to cover such costs.
- Under Florida law, contractors, subcontractors, and material suppliers who furnish labor or materials for the improvement of real property may have construction lien rights if unpaid.
- Nothing in these Terms & Conditions is intended to waive any rights or obligations under Chapter 713, Florida Statutes.
